Civil Process
  
 The Constable and their deputies have all the powers and responsibilities of any peace officer in the state. They may enforce traffic regulations, make arrests, serve warrants, conduct criminal investigations, and file criminal cases. However, they have additional enforcement responsibilities that police officers are not charged with. The Constable and their deputies have the additional responsibility of serving and executing civil court orders and providing courtroom security to the justice court in their precinct which is our top priorties.

Civil law deals with the branch of law which enforces or protects private rights and the prevention or redress of private wrongs. All process that is received from the Justice of the Peace office in Precinct #2 is served by our office. In addition, process that is received from other Wharton County Justice of the Peace offices and out of county process, where the defendants resides or place of employment is within Precinct #2 is served by our office. All fees that are received by the Constable’s office is deposited into the Wharton County general fund. Our office executes and returns to courts all warrants, capias warrants, other criminal process, citations, subpoenas, forcibles and writs. It is the mission of the Constable's office to be efficient, professional and well trained to give the best possible service to the citizens of Wharton County.

State guidelines on training for peace officers require that each peace officer receive 40 hours of training every two years. Specific mandated training requires all peace officers receive civil rights, racial sensitivity, cultural diversity, child abuse, child neglect, family violence, sexual assault and issues concerning sex offender characteristics training. What seperates Constables and Deputy Constable from other peace officers is they must complete a 20-hour course of instruction in civil process each 48 month cycle as a part of continuing education program for peace officers (Section 1701.354, Occupations Code).
